Reclamaciones por lesiones de espalda/espina dorsal
Las causas del dolor de espalda son múltiples: esguinces, tropiezos y resbalones, lesiones deportivas y lesiones causadas en el lugar de trabajo, en lugares públicos o en accidentes de tráfico. Una lesión de espalda puede tener un efecto devastador en el estilo de vida habitual de una persona.
La columna vertebral, o espina dorsal, es una estructura compleja formada por 33 huesos y tejido que se extiende desde el cráneo hasta la pelvis. Estos huesos (vértebras) protegen los tejidos nerviosos de la médula espinal. Existen diferentes tipos de vértebras a lo largo de la espalda.
La prevención de las lesiones de espalda es uno de los principales retos en materia de seguridad laboral. Los empresarios están obligados por ley a cumplir una estricta normativa de salud y seguridad. Es su deber proporcionar un entorno de trabajo seguro para todos los miembros del personal en todas las áreas del lugar de trabajo, tanto dentro como fuera.
Lesiones de espalda relacionadas con el trabajo
Las lesiones de la columna vertebral relacionadas con el trabajo pueden producirse al levantar, colocar, transportar y sujetar materiales manuales. Un accidente que provoque una lesión temporal o permanente de espalda también puede ser consecuencia de un entorno inseguro o de maquinaria o herramientas deficientes. Si ha sufrido o sufre una lesión de espalda o columna vertebral por un accidente laboral, puede tener derecho a presentar una demanda por lesiones de espalda. La cuantía que tendrá derecho a reclamar dependerá de:
- La gravedad de la lesión
- Efectos a corto o largo plazo de la lesión
- Pérdida de ingresos
- Pérdida de ingresos potenciales

No Win No Fee – Este es el término legal utilizado para describir cómo los abogados asumen un caso en el que pagan los costes del litigio, por lo que los bufetes de abogados irlandeses que operan sobre esta base pagan los informes médicos, los derechos de timbre, los honorarios de los expertos y todos los demás costes legales asociados con su caso de lesiones personales. Iniciar su caso de lesiones
Si ha sufrido lesiones, pérdidas, daños o gastos como consecuencia de la acción u omisión negligente de otra parte, puede tener derecho a reclamar a esa otra parte o a sus aseguradores. Iniciar un caso con nuestro equipo jurídico es un proceso sin complicaciones. Salvo algunas excepciones muy estrictas, dispone de dos años a partir de la fecha del accidente para iniciar un procedimiento judicial. Para los menores de 18 años se aplica una política de reclamaciones diferente.
¿Cuánto vale mi reclamación?
Los importes de las reclamaciones por lesiones personales son difíciles de valorar al inicio de cualquier caso, pero el valor de su caso en términos de Daños y Perjuicios Generales dependerá de la gravedad de la lesión, el dolor, el sufrimiento y las molestias derivadas del tiempo de recuperación y el pronóstico para el futuro. Además, tiene derecho a reclamar todas las pérdidas económicas y gastos que haya sufrido como consecuencia del accidente.
